Jewtor LLC Customer Terms of Service

Welcome to Jewtor LLC (“Jewtor”). By using our service, you agree to these Terms of Service. Please read them carefully.

1. Description of Services

Jewtor connects independent tutoring professionals with families and individuals seeking educational and tutoring services.

2. Student Registration and Responsibility

All agreements and financial arrangements must be established by an adult or, for minor students, by a parent or legal guardian. The registering adult assumes full responsibility for coordinating schedules, overseeing participation, and paying for lessons.

3. Billing, Payments, and Cancellations

Rates and Fees: All tutoring sessions are billed at the rates provided to you in writing via email or invoice from Jewtor.
Payment Due Dates: Invoices are due within three business days of the invoice date. You agree to make payment using Jewtor’s designated payment processor prior to or by the stated due date.
Late Payments & Service Suspension: Unpaid balances past the due date may be subject to a late fee of $15 or 1.5% per month, whichever is higher. Jewtor reserves the right to suspend or cancel upcoming scheduled sessions if an account has an outstanding past-due balance.
Cancellations: If you need to cancel or reschedule a lesson, you agree to notify the tutor by the night before the scheduled session. You agree that lessons missed or canceled after this timeframe will be billed at the full rate, because the tutor has kept that time slot for you.

4. Platform Use and Safety

Online Platform Use: All tutoring sessions will take place on Jewtor’s designated online video platform for safety and quality assurance.
Adult Students: For adult students, all scheduling, logistics, and feedback are handled directly between the student and the tutor.
Minor Students: You agree, to ensure student safety, that all communications regarding scheduling, logistics, and feedback for minor students must occur exclusively between tutors and the student’s parent or legal guardian. Direct communication between tutors and minor students outside of lessons is strictly prohibited.

5. Non-Circumvention

Jewtor invests heavily in our tutoring platform. You agree to book and pay for all tutoring sessions with any Jewtor-introduced tutor exclusively through our platform during your time with us and for 12 months after your final session.

6. Lifecycle Events

You are free to independently contract with a tutor to officiate a Bar/Bat Mitzvah or other lifecycle event, and that will not be considered a violation of the non-circumvention provision. Any contract you make with a tutor or with any other officiant is an external arrangement completely outside of this agreement; you acknowledge that Jewtor does not manage, coordinate, or receive payment for these events, assumes no liability for them, and you release Jewtor from any related claims.

7. Session Recording Consent

To ensure student safety, you agree that lessons may be recorded by a third-party provider such as Lessonspace. To balance this emphasis on student safety with student privacy, recordings are automatically and permanently deleted after 90 days in accordance with industry standards. You agree both to the recording of lessons and to their deletion after 90 days, and you agree not to hold Jewtor liable for any technical failures on the part of third-party recording and storage services.

8. Student Safety & Conduct Policy

Student safety is our highest priority. We maintain zero tolerance for any form of harassment, abuse, or inappropriate behavior. All tutors undergo background checks prior to joining Jewtor. You acknowledge that tutors operate as independent contractors, and you agree not to hold Jewtor responsible for unauthorized actions of independent contractors. You agree to report any safety concerns to Jewtor management immediately (and, when appropriate, to law enforcement). Jewtor will act swiftly to investigate and address any reported safety concern.

9. Limitation of Liability

While our tutors bring expert knowledge and instruction to their lessons, you acknowledge that a student’s confidence and fluency depend on factors outside of Jewtor’s control, including consistent practice and review at home, lesson attendance, dedication, and family support. Because every student learns at their own pace, you agree that Jewtor LLC cannot guarantee specific religious or educational outcomes, grades, or religious service performance abilities.

You agree that, to the fullest extent permitted by law, Jewtor LLC, its owners, managers, officers, agents, and independent contractors shall not be liable for any indirect, incidental, or consequential damages arising from our services or event outcomes. You agree that Jewtor LLC’s total aggregate liability for any claim or dispute shall not exceed the total fees paid by you to Jewtor LLC in the three (3) months preceding the claim.

10. Dispute Resolution

You agree that these terms and any dispute arising out of them shall be governed exclusively by the laws of the State of Wyoming without regard to conflict of law principles.

Mandatory Informal Resolution (30-Day Cure Period): Before initiating any formal legal proceeding, arbitration, or small-claims filing, both you and Jewtor LLC agree to make a good-faith effort to resolve any dispute informally. To initiate this process, the disputing party must send a written Notice of Dispute to the other party describing the nature of the claim, the facts, and the requested relief. Notices to Jewtor LLC must be sent via email to in**@****or.com. Both parties agree to negotiate in good faith for a period of thirty (30) days from the date the Notice of Dispute is received. Neither party may initiate arbitration or court proceedings until this 30-day period expires.
Small Claims Court Option: Notwithstanding the agreement to arbitrate below, either party may bring an individual action in a court of small claims having jurisdiction, provided the claim seeks relief solely within the monetary limits and scope of that small claims court.
Binding Virtual Arbitration: If a dispute cannot be resolved through the informal resolution process within thirty (30) days, any remaining claim, dispute, or controversy arising out of or relating to these Terms, the services provided, or the relationship between the parties shall be settled exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration hearing shall be conducted virtually via videoconference unless both parties mutually agree otherwise in writing. The arbitration shall be governed by the substantive laws of the State of Wyoming, without regard to its conflict of laws principles. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this agreement. Each party shall pay its own arbitration administrative and arbitrator fees in accordance with the applicable rules of the arbitration provider. However, if the arbitrator determines that either the substance of a claim or the relief sought is frivolous, brought in bad faith, or intended for an improper purpose, the prevailing party shall be entitled to recover its reasonable attorney’s fees, legal costs, and arbitration expenses. The arbitrator shall not consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding unless both parties explicitly consent in writing.
Class Action Waiver: You agree to bring any claims against Jewtor only in an individual capacity and not as a class action or group proceeding.

11. Modifications to Terms

Jewtor reserves the right to modify these terms from time to time. We will provide notice of updates by email or by posting the revised text on our website.

By continuing to use Jewtor’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
